Do You Need A Permit For A Retaining Wall In Pennsylvania?

Usually the dividing line is four feet. Under Pennsylvania’s Uniform Construction Code (34 Pa. Code § 403.62, which governs one and two family dwellings), a retaining wall that is not over four feet in height, measured from the lowest level of grade to the top of the wall, is generally exempt from a building permit.

There is an important exception. That exemption does not apply if the wall supports a surcharge, meaning something is loading it from above: a driveway, a patio, a structure, or a meaningful slope. A three foot wall holding back a driveway can require a permit when a three foot wall holding back a garden bed does not.

Municipalities are also free to be stricter than the state minimum, and many in Dauphin and Lancaster County are, particularly around stormwater. What Makes A Retaining Wall Last

A retaining wall is not a stack of block. It is a drainage structure that happens to hold soil, and walls fail for drainage reasons far more often than they fail for strength reasons.

Clean stone behind the wall and a drain at the base give water somewhere to go. Backfill a wall with the soil you just dug out and you have built a dam. Saturated soil weighs dramatically more than dry soil, and that added pressure is what pushes walls out of plumb.

A compacted base

The base course sets everything above it. It gets excavated below grade, built on compacted stone, and levelled properly, because every error in the first course multiplies as the wall goes up.

Past a certain height and load, a wall needs reinforcement extending back into the soil it retains, so the wall and the earth behind it act as one mass. Where that threshold sits depends on wall height, slope and surcharge, which is another reason the wall gets designed on the site rather than from a photo.
